Terms of Service

These Terms of Service (hereinafter "Terms") govern the use of the Dashyn platform, accessible at dashyn.fr. By creating an account or using the service, you accept these Terms in their entirety.

Definitions

  • -"Platform" or "Service": refers to the Dashyn web application accessible at dashyn.fr
  • -"Publisher": Sander FERREIRA, self-employed (auto-entrepreneur), SIRET 933 691 222 00014, 8 rue Jules Lopard, 77450 Esbly, France
  • -"Freelancer User": any natural or legal person registered on the platform as a service provider
  • -"Client User": any person invited by a Freelancer User to access the client portal
  • -"User": refers to either a Freelancer User or a Client User
  • -"Content": refers to data, documents, invoices and any information entered or uploaded by Users

Purpose of the Service

Dashyn is a management platform designed for freelancers and self-employed professionals. It allows you to:

  • -Manage your clients and their information
  • -Track your projects and their milestones
  • -Create and manage quotes and invoices compliant with French regulations
  • -Provide a client portal for project tracking and invoice payments
  • -Store and share documents
  • -Receive online payments via Stripe

Registration and Account

Registration is restricted to adults with legal capacity. By creating an account, you declare that the information provided is accurate and complete.

You are responsible for the confidentiality of your login credentials. Any activity carried out from your account is deemed to be your doing.

If you suspect unauthorised use of your account, you must inform us immediately at contact@dashyn.fr.

Only one account is permitted per person or legal entity.

Freelancer User Obligations

  • -Provide accurate and up-to-date legal information (SIRET, contact details, billing information)
  • -Ensure that invoices generated via the platform comply with the regulations applicable to your business
  • -Comply with the GDPR when collecting and processing your own clients' data
  • -Use the service in accordance with these Terms and applicable law

Dashyn provides invoice generation tools compliant with French regulations. However, the Freelancer User remains solely responsible for the accuracy and compliance of their accounting documents.

Client User Obligations

  • -Access to the client portal is subject to an invitation from the Freelancer User
  • -The Client User agrees to use the portal only to view information intended for them
  • -The Client User is responsible for the confidentiality of their login credentials

Pricing

Dashyn offers free access with limited features.

Paid plans may be offered. Prices, conditions and features of each plan are detailed on the pricing page.

Payments between Freelancer Users and their clients are processed through Stripe. Dashyn is not a party to the service agreement between the freelancer and their client.

We reserve the right to modify prices. Any changes will be communicated with 30 days' notice.

Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, you have 14 days from the date of subscription to exercise your right of withdrawal, without giving any reason.

However, in accordance with Article L.221-28, if you access the service immediately after subscription and expressly request to do so, you acknowledge that you waive your right of withdrawal.

Subscription Cancellation

You may cancel your subscription at any time from your account settings.

Upon cancellation, your access to paid features is maintained until the end of the current billing period. No pro-rata refund is provided.

If you switch from a paid plan to the free plan and exceed the free plan limits (number of clients, invoices, etc.), you will retain read-only access to your existing data but will not be able to create new entries until you are back within the limits.

Subscriptions are not automatically renewed if you do not wish them to be. You will be notified before each renewal.

Intellectual Property

The Dashyn platform, its interface, source code, texts, images and graphic elements are protected by intellectual property law and remain the exclusive property of the Publisher.

Users retain ownership of their Content (client data, invoices, documents). By using the service, you grant Dashyn a limited, non-exclusive licence to store, display and process this Content for the purpose of operating the service.

Any reproduction, modification or exploitation of the platform without authorisation is prohibited.

Service Availability

Dashyn endeavours to ensure service availability 24/7.

Interruptions for maintenance may occur. We strive to schedule them outside business hours and to notify users in advance.

Dashyn does not guarantee uninterrupted or error-free operation. The service is provided "as is".

Liability

Dashyn shall not be held liable for indirect damages resulting from the use or inability to use the service.

The User is solely responsible for backing up their data. Although Dashyn performs regular backups, we recommend keeping independent copies of your important documents.

Dashyn cannot be held responsible for the actions of third-party services (Stripe, hosting provider) even if these services are integrated into the platform.

Dashyn provides invoicing tools but does not replace an accountant. The User remains responsible for their tax and accounting obligations.

Termination

You may delete your account at any time from your account settings or by contacting us at contact@dashyn.fr.

We reserve the right to suspend or delete an account in the event of a breach of these Terms, without notice in the event of a serious breach.

Upon account deletion, your personal data will be deleted in accordance with our Privacy Policy. Data subject to legal retention obligations (invoices) will be retained for the required period.

Before deleting your account, you may request an export of your data (right to data portability).

Changes to the Terms

We reserve the right to modify these Terms. In the event of a substantial change, you will be notified by email or via a notification in the application at least 30 days before the new conditions take effect.

Continued use of the service after the changes take effect constitutes acceptance of the new Terms.

Governing Law and Disputes

These Terms are governed by French law.

In the event of a dispute, the parties agree to seek an amicable solution before any legal action. Failing an amicable agreement, French courts shall have jurisdiction.
